Congratulations to our partner, Jonny Kool, for his outstanding work in settling a Bronx County action for $5.25 million on behalf of a 31-year old construction worker.  The plaintiff, a union Laborer for Local 79, was performing demolition work at a major commercial building project that involved the removal of a freight elevator.

Pursuant to New York’s Labor Laws, the building owner and project General Contractor, were legally required to provide him with protection from both falling objects as well as protecting him from falling while working.  In the instant case, the injured worker was attempting to get onto a scissor lift when the lift was struck by falling debris from the elevator removal.  This caused him to fall approximately 25-30 feet down the elevator shaft sustaining catastrophic injuries as a result.

He sustained injuries to both ankles as well as his cervical spine and required multiple surgical procedures.  He was totally disabled from his job as a laborer and requires significant future medical treatment.

This settlement will allow him to recover the income he lost and cover his future medical expenses as they arise.
