Third-Party Injury Claims

In New York State, you must report a work injury to your employer within 30 days. This is not the same as filing for workers’ comp. You must file for workers’ compensation benefits by completing the paperwork yourself or contacting an attorney for assistance. Do not expect your employer to do it.
You should also seek medical care for your injury. It is very important that you tell your doctor how the injury happened and that he or she documents each injury you have.
