Motorcyclists are at Greater Risk of Injury in Queens Accidents Than Car Drivers

Due to the nature of motorcycles, their riders are exposed to the threat of a serious injury in the event of any type of accident. Motorcycles aren’t as stable as cars based solely on the fact that motorcycles drive on two wheels, which is inherently less stable than four wheels. As a consequence, motorcycles are much lighter in weight and smaller in stature than a lot of other motor vehicles on the road, they are susceptible to a higher level of potential damage even at lighter impacts. Motorcycles are also less visible on the road than other vehicles. A nearby automobile motorist may have trouble seeing a small and agile motorcycle than they would another automobile. As a result, many accidents occur where the driver of the automobile may cut-off the motorcyclist and fail to yield before a collision occurs. The difference between the driver of the automobile and the motorcyclist in this situation would be that there is less chance of the automobile driver suffering injuries. The motorcyclist’s risk of injury on the other hand, is much higher.

Insurance and Liability Issues for Motorcycles

A motorcycle by definition is not considered a “motor vehicle”, according to the “No-Fault Law” system that is in place in New York State. The No-Fault Law states that if an operator of a motor vehicle gets into an accident, regardless the level of fault, their insurance companies must pay their medical bills; in some cases they must also compensate for lost wages. However, operators of motor vehicles in Queens are also limited. New York State only grants them the right to sue the opposing motorist, who bears the greater fault, only in the case that the amount of bodily damage that has been incurred satisfies what New York State considers a “serious injury”. Since the motorcycle isn’t considered a motor vehicle in the eyes of New York State, motorcyclists are exempt from the No-Fault insurance benefits. Their rights, however, to a personal injury lawsuit are not limited to only serious injuries like automobile operators. Queens motorcyclists are capable of suing for even minor injuries that they have incurred due to the negligence of the other motorist(s).

Motorcyclists in Queens are obligated by New York law to have insurance of at least $25,000 per person that is injured in any one accident and a minimum of $50,000 for the death of one person in any one accident. In addition, it is mandatory to have a supplementary $50,000 if two or more people are injured in any one accident, and $100,000 if two or more persons die in one accident.

Motorcyclists also have the option of purchasing Uninsured Motorist or Underinsured Motorist insurance. An uninsured motorist is classified as an individual who doesn’t have any insurance or fails to have coverage that satisfies the New York State minimum. An underinsured motorist is a person who met the New York State minimum; however, their coverage wasn’t able to compensate for the full damage of the accident. In these cases, UM/UIM would activate and help compensate for your damages.
