Pertinent New York Construction Accident Laws

When filing a construction accident lawsuit, it is important that victims are aware of New York labor laws 240 (1) and 241 (6). The aforementioned laws dictate that the general contractors and property owners are responsible for maintaining a safe worksite and safe worksite practices.

Labor law 240 (1), also known as New York's "scaffold law," places absolute liability on the general contractor and owner in cases where a worker suffered an elevation related injury. Under this statute, general contractors and property owners may be liable when a construction worker suffers an injury on the worksite from an elevated fall or from an object falling from elevation. General contractors and property owners may be found liable in all instances where an elevation related injury occurred. Owners of one and two-family dwellings cannot be held liable under this statute.

Under Labor Law 241 (6), owners and contractors are saddled with the duty of providing reasonable and adequate protection and safety during the demolition or construction of a building and excavation work. This statute places vicarious liability upon a general contractor or owner when a specific safety rule under section 23 of the Industrial Code was violated. In other words, contractors and owners may be liable for any injuries resulting from a violation of section 23 of the Industrial Code, even when they were not directly responsible for the violation.

The case settled for $10.5 million during jury deliberations.
  • A worker fell from near the top of a ladder while handing off wood to another laborer. The fall caused the worker to suffer major injuries which rendered him a paraplegic. As a result, the worker is paralyzed from the waist up. Queller, Fisher, Washor, Fuchs & Kool settled the case for a confidential amount between $5 and 10 million.
  • $3.75 million settlement during jury selection. An undocumented construction worker was working in the basket of a cherry picker on a bridge. Unbeknownst to the worker, the cherry picker's controls were defective. As a result, the arm of the machine inadvertently moved, resulting in the worker's shoulder being trapped between the basket and bridge. The accident caused the worker to suffer a severe brachial plexus injury. Our construction accident attorneys settled the case during jury selection.
  • $2.75 million settlement by Barry Washor in Kings County Supreme Court for $2.75 million on behalf of a 37-year old laborer who fell from a ladder while doing sheet rock work at a construction site. As a result of the fall, the claimant sustained multiple injuries requiring surgery including arthroscopic shoulder surgery and a cervical fusion. He had not returned to work since the accident.
  • $1.95 million recovery for a worker who suffered multiple fractured bones in a fall. The plaintiff had been working on the construction of new residential homes in the Bronx. While working on the second floor, he fell through a hole that had not been properly covered, resulting in his injury.
  • $1.75 million recovery for a worker who was injured by a falling brick. The worker had been pointing bricks when one fell from above and landed on him. Due to the fact that the area the plaintiff has been working in lacked proper cover, he suffered orthopedic and neurological injuries to his arm which required surgery. Queller Fisher was able to recover the plaintiff $1.75 million in a labor law lawsuit.
  • $1.7 Million settlement by Jonny Kool in an Orange County Labor Law Case on behalf of bridge painter who fell off scissor-lift truck which moved unexpectedly. The injured worker sustained a complex, comminuted fracture to his elbow requiring emergency surgery as well as a fractured pelvis. He has not been able to work as a bridge painter since the time of the accident.
  • $1.55 Million settlement by Dallin M. Fuchs where laborer lost vision in one eye due to not being provided with proper eye protection
