Wrongful Death
 When a person dies because of someone else's negligence, or failure to use ordinary care, a wrongful death claim results. There are significant limitations on what types of damages are recoverable in wrongful death cases in the state of New York. Thus, careful attention must be paid to proving recoverable losses in their entirety. These recoverable damages include pre-death conscious pain and suffering and "economic" damages.
Economic damages are not limited to actual financial loss. For example, a child's loss of parental guidance is considered under the law to have an economic value, which can be determined by a jury, or agreed upon via settlement.
A 2004 case in which a homemaker was struck and killed by a city bus provides a good example of a wrongful death lawsuit.
