Third-Party Injury Claims
If a third party, such as the driver of a vehicle that hits you, is responsible for your injury, you may be able to sue for personal injury damages in addition to workers' compensation benefits. There are many other instances where workplace accidents are caused by a third party other than your employer or co-employee, whereby your claim for damages will not be limited to workers' compensation. Sometimes, the liability of a third party may be based on ownership, operation or control of the property where the accident occurred. It is important that our office conduct an investigation and analysis of the circumstances of your particular workplace accident.
Important Workers' Compensation Information
In New York state, you must report a work injury to your employer within 30 days. This is not the same as filing for workers' comp, however. You must file for workers' compensation benefits by completing the paperwork yourself or contacting an attorney for assistance. Do not expect your employer to do it.
You should also seek medical care for your injury. It is very important that you tell your doctor how the injury happened and that he or she documents each injury you have. If a representative from your employer or employer's insurance company asks you to give a statement while you are at the hospital, contact an attorney before you speak to them.
