Do You Have A Valid Claim?

In order to have a valid demolition or renovation accident lawsuit, one of the following must have occurred:

  • An Injury Was Caused By an Elevated Fall: New York Labor Law 240 (1) states that construction workers may be entitled to compensation when they suffer an onsite injury from an elevated fall or from an object falling on them from an elevated surface.

Property Owners and general contractors may be vicariously liable should an injury occur due to a violation of rule 23 of the Industrial Code.
  • A Third Party's Negligence Caused an Injury: Construction workers may be able to file a negligence lawsuit against a third party who caused their injury; provided the third party isn't a co-worker. For example, if a construction worker from another company leaves flammable materials near a heat source, and an explosion occurs, injured workers may be able to file a lawsuit against the negligent worker.
