In a horrific tragedy, another New York crane accident has claimed a life. Recently, Douglas Fitmaurice was operating a 35-ton crane at the Rochester Gas & Electric (RG & E) hydroelectric station. While moving large concrete blocks, the crane tipped over into the Genesee River gorge, trapping Fitmaurice underneath.
Firefighters, medics and other emergency responders quickly assessed the danger of the situation: though Fitmaurice was alive and conscious, if rescue efforts caused the crane to shift, it could cause further harm or death. After calling in special equipment, firefighters worked for nearly four painstaking hours to lift the crane and release the operator.
Eventually, rescuers were able to partially free Fitmaurice. However, he died shortly after, apparently due to crush syndrome. This medical condition is caused when a portion of the human body is trapped by extreme weight. The pressure cuts off blood flow which causes cells to die and toxins to be formed. When the weight is removed, the blood and toxins rush back into the uninjured areas of the body leading to shock, organ failure and death.
The U.S. Occupations Safety and Health Administration (OSHA) is conducting a full investigation of the crane accident with plans to complete the inquiry within six months. If OSHA finds violations, the owner of the crane could be cited and fined. In addition, depending on who is at fault for the accident, the family may have legal right to bring a wrongful death claim.
Dangerous Construction Sites
Construction sites where heavy equipment is used are known to be dangerous workplaces. However, laws are in place to protect workers from preventable accidents due to negligent coworkers, companies and/or property owners. Yet, too often, construction workers suffer serious injury or death due to the careless oversight or inattention of those obligated to maintain safe job sites.
Following serious construction accidents, such as this New York crane fail, injured individuals and families of those killed may have the legal right to bring civil lawsuits against the people, companies and manufacturers deemed responsible. Personal injury and labor law attorneys experienced in handling workplace accident claims can help victims determine if there are sufficient grounds to pursue financial compensation for loss.
